In a letter to Inez Tennenbaum, Commissioner of the Consumer Products Safety Commission (CPSC), Senator Gillibrand points out that while such magnet toys are marketed to children over the age of 14, injury reports indicate that these products are getting into the hands of younger children. Swallowing a high-powered Neodymium magnet can result in serious injuries, including bowel ulcerations, intestinal damage, blood poisoning and even death. According the Senator, there have been at least 43 incidents of children and toddlers who accidentally swallowed these magnets since 2010. This year has already recorded 19 reported incidents of children who accidentally ingested these magnets. In March, for example, a 3-year-old girl sustained three holes in her lower intestine and one in her stomach after swallowing 37 high-powered Buckyballs magnets.

The CPSC issued a recall for Buckyballs magnet toys in March 2010 that were incorrectly marked for ages 13 and older, a violation of toy labeling standards. Other manufacturers, including MegaBrands Inc, the maker of Magnetix toys, have issued several recalls following serious injuries to children. According to Senator Gillibrand, the CPSC has also responded to the risks posed by these toys by alerting consumers through an ad campaign and by placing warning labels on the magnets’ packaging.
