According to The Plain Dealer, Cleveland, Ohio has become the 39th state in the nation to ban texting while driving. Ohio?s new texting while driving ban makes texting and use of other portable electronic devices a primary offense for drivers under the age of 18. However, the new law provides for only secondary enforcement for adult violators, meaning police will need another reason, such as speeding, to stop and cite anyone over the 18 for texting while driving. While Governor Kasich and Ohio lawmakers deserve praise for allowing the texting ban to become law, they still have not gone far enough to ensure that more Ohio motorists will not become victims of distracted driving.

According to the Ohio State Highway Patrol, 31,231 motor vehicle crashes were caused by distracted driving in Ohio between 2009 and 2011. These accidents resulted in 74 fatalities and 7,825 included injuries. According to the National Highway Safety Administration 5,474 people died nationally in 2009 in distraction-related crashes ? of these, 18 percent involved cell phone use. Governor Kasich, who lost his own parents to a drunk driver, expressed support for tougher legislation when he signed the new texting ban into law this past June. The Cochran Firm ?
